Terminate My Tenancy

Termination If you wish to end your tenancy with Broadland Housing, there are a number of steps which must be followed, as outlined below. Please note that failure to follow this step-by-step process could result in you having to pay unwanted charges. In addition, it could result in difficulty when it comes to you finding a new home elsewhere. The 4 step termination process:

Step 1: You must provide us with 28 days notice to quit, unless your tenancy states otherwise. This should be provided in writing, either by email or by hand-written letter.

Step 2: You will need to provide us with access to your home during the 28 day notice period, so that we can complete a full property inspection. You will also, at the point, need to provide us with a forwarding address and ensure all outstanding rent owing has been paid.

Step 3: You must ensure your home is left in good condition and is clear of all unwanted to possessions. Note that failure to do this will result in charges, which you will become liable for.

Step 4: Ensure your home is locked and the keys are returned to Broadland Housing as agreed.

What if you change my mind and no longer want to move?

If, after handing in your notice to quit, you decide that you no longer wish to move out of your home, it may be possible for you to remain on, subject to the following two conditions: (1) You are still within your 28 day notice period (2) Your home has not been offered to someone else as part of our allocation process. If you do find yourself in a situation where you have provided us with your 28 days notice to quit, but have since changed your mind and wish to stay, please make contact with us as soon as possible.

Viewings

Once you have given us notice that you wish to end your tenancy, we will need to get new tenants into the property as quickly as possible. Because of this, we may need access to your property within the 28 day notice period, in order to show it to interested parties. As a result, we may need you to provide us with access to your home and we will give you reasonable notice of this to ensure you are not discommoded in any way. Once you have left your home

Upon your departure, we will complete a property inspection and you will be charged for any house clearance, cleaning, or repairs required. With regard to rent, any refunds that may be owed to you will be reimbursed following inspection. In the same way, should any rent be owing to Broadland Housing by you, you will be required to pay this at this stage of proceedings. If you have failed to provide a forwarding address as required, we will use a debt tracing agency to help us locate you in order to discuss any outstanding arrears. Finally, please note that we will provide any future potential landlords with full reports on how your tenancy was conducted, for a period of up to 5 years after your tenancy has ended. Any damage, arrears, or anti-social behaviour engaged in during your tenancy with Broadland Housing may therefore impact on your ability to get another home.

If you abandon your home

If you decide to move out of your home without giving us the required 28 day notice and fail to return your keys to us, the law determines that you have abandoned your home. In this situation we will go through the legal process of ending your tenancy but you will continue to be charged rent until the tenancy officially comes to an end. In addition, you will also incur charges for any works that we are required to carry out at your property as well as any legal charges which accrue a result of your abandonment.

In the event of a death

We understand just how difficult things can be when someone you know dies so we are here to help when this happens. If you are dealing with the affairs of a tenant who has died, please note that you should contact us as early as possible. This will ensure that we can help you through the process of ending the tenancy as well as the process of handing the home back to Broadland Housing.

In the event of the death of a tenant, we will be required to go through the process of formally ending the tenancy. The reason for this is simply that, by law, a tenancy is not ended when a tenant dies. As a result, we will be required to serve a Notice to Quit, in order to bring the tenancy to an end. If you believe you are entitled to succeed the tenancy you should let us know as soon as possible. In this situation, we will need to establish a number of things about you: who you are, your relationship to the deceased tenant, how long you were living with the tenant prior to their death etc.
